Welcome to Waynia. These Terms of Use ("Terms") govern your access to and use of the Waynia mobile application ("the App") provided by Waynia ("we", "our", or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent that you meet this age requirement. If you are under 18, you must have consent from a parent or legal guardian.

2. Account Registration

To use certain features, you must sign in using Google or Apple authentication. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account. You agree to provide accurate and complete information and to update it as necessary.

3. Use of the App

Waynia provides AI-powered travel planning tools, including trip generation, AI chat assistance, multi-location trip planning, nearby place discovery, and related services. You agree to use the App only for lawful purposes and in accordance with these Terms.

4. AI-Powered Features and Third-Party Data Sharing

The App uses Google Gemini AI to provide travel recommendations, trip plans, and AI chat responses. When you use AI features, the following data may be sent to Google's Gemini API for processing:

This data is sent to Google for the sole purpose of generating AI responses and is subject to Google's Privacy Policy. You will be asked to provide your consent before any data is shared with the AI service. You may withdraw your consent at any time through the App settings, which will disable AI-powered features.

5. Subscriptions and Payments

5.1. Subscription Plans

Waynia offers free and premium subscription plans. Premium features are available through auto-renewable subscriptions:

Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price.

5.3. Managing Subscriptions

You can manage or cancel your subscription at any time through your Apple App Store or Google Play Store account settings. Cancellation takes effect at the end of the current billing period.

5.4. Payment Processing

All payments are processed by Apple (App Store) or Google (Google Play). We do not collect or store your payment or credit card information. Payment terms are governed by the respective app store's terms and conditions.

5.5. Free Trial

If a free trial is offered, it will be specified at the time of purchase. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription.

6. Intellectual Property

All content, features, and functionality of the App — including but not limited to text, graphics, logos, icons, images, software, and design — are owned by Waynia and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the App without our prior written consent.

7. User Content

You retain ownership of any content you create within the App, such as trip plans and chat messages. By using the App, you grant us a limited license to store and process your content as necessary to provide the App's services. We do not claim ownership of your content.

8. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that:

Travel information generated by the AI is for informational purposes only. Always verify important details such as pricing, availability, and safety conditions independently before making travel decisions.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Waynia shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of the App. Our total liability for any claims arising from these Terms shall not exceed the amount you paid for the App's subscription in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Waynia and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the App or violation of these Terms.

11. Termination

We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App ceases immediately. You may delete your account at any time through the App's settings.

12. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the App, you consent to the practices described in our Privacy Policy.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the App or on our website. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Uzbekistan, without regard to conflict of law principles.
